En este trabajo se sostiene que la teoría del derecho iberoamericana ha malinterpretado la teoría del razonamiento jurídico de Jeremy Waldron, presentándola como una teoría formalista de la adjudicación, y a Waldron como un positivista excluyente. Esto se debe a una lectura sesgada de su teoría del derecho, que se explica, a su vez, por la imagen que el constitucionalismo ha construido en torno a Waldron, como un opositor de Dworkin. Este trabajo muestra que Waldron suscribe a una teoría “dworkiniana” (...) del razonamiento jurídico, la que opera como eslabón entre su teoría de la democracia y su teoría más reciente de la dignidad humana. Ambas cuestiones han sido virtualmente ignoradas por el medio académico hispanoparlante. (shrink)

The aim of our research is to analyze how different religions influence business ethics. We develop an index of practices in the field of business ethics, made up of 19 items containing practices related to workers, consumers, products, human rights, management of ethical conflicts, and crime prevention. Also, we consider a wide range of religion affiliations. To undertake this research, we use a panel data sample composed of 11,956 firm‐year observations from 18 countries. Drawing on stakeholder theory, we posit some (...) hypotheses based on the religions considered. The results obtained show that a higher percentage of religious adherents in the country where a company does business usually involve the implementation of more ethical practices in the corporate field. These findings are obtained for Christian, Islamic, Jewish, and Hindu religions. In contrast, this does not stand for Buddhist and folk religions. Also, countries where there is no predominant religion do not show a confluence between religion and ethical corporate practices. (shrink)

Por supuesto, es imposible responder estas preguntas en esta corta presentación, tal vez sean imposibles de responder sin importar la extensión del texto que las analice. No obstante, nos parece necesario presentarlas para situarlas en un contexto que nos permita problematizar este dossier. Zygmunt Bauman4 planteó que tres campos de conocimiento: la filosofía de la historia, la antropología filosófica (...) y la estética, y un concepto: la cultura, emergieron en el siglo XVIII con el propósito de explicar la crisis de una forma de comprender y estar en el mundo, que se había pensado y vivido como natural y que parecía mutar en un orden radicalmente humano y, por ende, endeble, arbitrario y cambiante. Las metáforas se usan en sociología para poder explicar el imaginario de un tema como el secreto. Son capaces de poner de manifiesto la clase de realidad a la que es asociada comúnmente. Así, si el secreto es considerado un objeto, puede ser compartido, si es un lugar, puede ser donde escondamos algo, por el contrario, si pensamos que el secreto es un ser vivo, puede crecer sin que podamos hacer nada al respecto. La lógica metafórica se impone a menudo (...) sobre el sentido original. En este artículo usamos el análisis sociometafórico propuesto por Emmánuel Lizcano a una serie de discursos provenientes de entrevistas y grupos de discusión. (shrink)

Mixing methods is a well-known innovative meth- odologic proposal for research in the second half of the 20th century social sciences. Reading literature about it, I observed the aspect that justifies this paper: Authors of theoretical contributions on mixing methods recognized that this was known to be a practice already in use many centuries ago. Some of them even have re-examined the whole history of the scientific method to search precedents. They are however individual and theoretical precedents. I add in (...) this paper the practical projection of these and other methodological theories on people’s training from Greek classical times. My hypothesis is that liberal arts was the basic syllabus in Western -and westernized- educaion for more than a millennium in such a way that results of their training precisely involved to mixing methods. In return, to understand the liberal arts in the light of mixing methods shows new aspects of their historical interest. I study the theoretical basis of this syllabus from Cicero to Alcuin. More important for future research, I conclude that Alcuin’s thesis about the correspondence between the gifts of the Holy Spiritu and the seven liberal arts can be extended to the Aristotelian dianoethics habits and to Dilthey’s 20th-century sciences of mind. We use a quantum electrodynamics model, to study the evolution of maximally entangled bipartite states, as well as a maximally entangled tripartite states as a multipartite system. Furthermore, we study the entanglement behaviour of these output states in cavity QED as function of interaction time and the coupling strength. The present study discusses the separability and the entanglement limit of such states after interaction with a cavity QED.

Though Indigenous women in Mexico have traditionally exhibited some of the highest levels of maternal mortality in the country—a fact that some authors have argued was an important reason to explain the EZLN uprising in 1994—there is some evidence that the rate of maternal mortality has fallen in Zapatista communities in the Chiapas Highlands in the last two decades, and that other health indicators have improved. In this article, we offer an account of the modest success that Zapatista communities have (...) achieved in improving their health levels. In particular, we argue that Zapatista women have implicitly used a form of feminist standpoint theory to diagnose the epistemic (and economic) injustice to which they have been traditionally subjected and to develop an epistemology of resistance that is manifested in actions such as becoming health promoters in their communities. We also argue that this epistemology of resistance is partially responsible for the improvement of health levels in their communities. Finally, on the basis of our discussion of the Zapatista case, we suggest that standpoint theory could play an important role in other healthcare settings involving oppressed minorities. (shrink)

El objetivo del artículo es operacionalizar teóricamente la complementariedad significativa, de tres niveles de significación social (representaciones sociales, imaginarios y mitologías), a través de la construcción discursiva en la prensa alternativa digital chilena. A nivel metodológico, se aplica el análisis de contenido cualitativo, analizando dos notas de prensa pertenecientes a El Desconcierto y El Mostrador, haciendo alusión a la temática de la Marcha más Grande de Chile acaecida durante el Estallido Social de 2019. En términos de hallazgos y conclusiones se (...) evidencia a nivel teórico y operativo la estrecha dialéctica y complementariedad entre las tres nociones teóricas de significación mencionadas. Though it is held that some models in science have explanatory value, there is no conclusive agreement on what provides them with this value. One common view is that models have explanatory value vis-à-vis some target systems because they are developed using an abstraction process. Though I think this is correct, I believe it is not the whole picture. In this paper, I argue that, in addition to the well-known process of abstraction understood as an omission of features or information, (...) there is also a family of abstraction processes that involve aggregation of features or information and that these processes play an important role in endowing the models they are used to build with explanatory value. After offering a taxonomy of abstraction processes involving aggregation, I show by considering in detail several models drawn from different sciences that the abstraction processes involving aggregation that are used to build these models are responsible for their having explanatory value. In this paper we examine some of the economic and ethical consequences of different credit market regulations, including usury laws, complete prohibition of interest and providing ease to the borrower upon default. The references to these credit market regulations can be found in many religious and moral philosophy texts. We first examine the effectiveness of these regulations in deterring exploitative lending by developing a model that shows lending can be regulated through either act-based or harm-based regulations. We show that act-based (...) regulations which comprise usury laws and complete prohibition of interest deter lenders more than harm-based regulations which constitute bankruptcy laws. We then analyze that while the regulations may deter certain forms of lending behavior, they may also create certain externalities by contributing towards inequity and societal risk. We propose that a regulator’s choice of implementing credit market regulations maybe dependent on her ethical commitment towards growth and reduction of inequity. We suggest the usury laws are more ethical than bankruptcy laws; however, discouraging the use of debt contracts through prohibition of interest and encouraging the use of risk sharing contracts maybe the most ethical way to regulate the credit markets. La fundamentación metafísica que sirve de núcleo a la ética de la responsabilidad de Hans Jonas participa de unos determinados presupuestos acerca de la relación entre los aspectos objetivo y subjetivo de la ética, donde la objetividad se atribuye automáticamente a lo teórico y la relatividad subjetiva a lo valorativo. Con ayuda de la crítica que realizó Max Scheler de estos mismos presupuestos en el formalismo ético de Immanuel Kant, se trata de discutirlos y mostrar que suprimen el fundamento propio (...) de la moral, que reside en el conocimiento objetivo, pero al mismo tiempo afectivo, de cualidades materiales de valor en tanto que objetos intencionales del percibir afectivo. A passive brain–computer interface based upon functional near-infrared spectroscopy brain signals is used for earlier detection of human drowsiness during driving tasks. This BCI modality acquired hemodynamic signals of 13 healthy subjects from the right dorsolateral prefrontal cortex of the brain. Drowsiness activity is recorded using a continuous-wave fNIRS system and eight channels over the right DPFC. During the experiment, sleep-deprived subjects drove a vehicle in a driving simulator while their cerebral oxygen regulation state was continuously measured. Vector phase analysis (...) was used as a classifier to detect drowsiness state along with sleep stage-based threshold criteria. Extensive training and testing with various feature sets and classifiers are done to justify the adaptation of threshold criteria for any subject without requiring recalibration. Three statistical features along with six VPA features were used. The average accuracies for the five classifiers are 90.9% for discriminant analysis, 92.5% for support vector machines, 92.3% for nearest neighbors, 92.4% for both decision trees, and ensembles over all subjects’ data. Trajectory slopes of CORE vector magnitude and angle: m and m are the best-performing features, along with ensemble classifier with the highest accuracy of 95.3% and minimum computation time of 40 ms. The statistical significance of the results is validated with a p-value of less than 0.05. The proposed passive BCI scheme demonstrates a promising technique for online drowsiness detection using VPA along with sleep stage classification. (shrink)

Desde los inicios de la humanidad hasta finales de la Edad Media, la imagen del universo reflejaba una visión teológica, para girar en torno al hombre en el siglo XVI. Con la llegada de la revolución industrial, de la concepción cíclica del tiempo propugnada por el Humanismo se pasa a la idea moderna de progreso. Por último, se produce la evolución de la sociedad disciplinaria organizada en torno a la fábrica como lugar cerrado y en la que el individuo sabe (...) quien ostenta el poder, hasta la sociedad de control en la era tecnológica actual deslocalizada en empresas con individuos que tienen acceso a la información hasta cierto nivel. El hombre se sitúa en el panóptico y sabe que está siendo observado, convertido en una forma de entretenimiento voyeurístico y exhibicionista. La perversión del mundo informatizado en el que el optimismo ante la posibilidad de verlo todo, se contrapone al control de la información y a la vigilancia permanente. Esta deshumanización afecta también al terreno plástico, que pretende dar soluciones a través de un arte participativo con nuevos planteamientos, estéticas y soportes. Este artículo pretende generar claridades sobre el planteamiento sistémico, llevado a los universos de la escuela y la familia. Se plantean lugares de encuentro entre estos dos sistemas interconexionados por el pensamiento sistémico y la comunicación, rescatando que la escuela y la familia han sido determinantes en la configuración de subjetividades y sociedades. Estas reflexiones permiten concluir que las manifestaciones recíprocas de la familia y la escuela esculpen maneras de ser y de estar en el mundo.

This paper examines the ethical foundations of the Islamic financial industry which is strongly criticized for its similarity with conventional finance. In this paper, we argue that this criticism is based on the consequentialist reasoning. The deontological considerations are largely ignored when the focus is on aggregate returns and associated product features. We build an economic model which allows us to examine the implementation of deontological rules in the Islamic financial products along with examining their consequences. We show that the (...) market forces may cause the returns and the attributes of Islamic financial products to converge with conventional finance even though the industry may be adhering to the Islamic deontological rules. We build a model to show that there may exist ‘Epsilon States’ where the deontological rules are followed by the Islamic finance industry, but their impact is not significant. We argue that the source of these ‘Epsilon States’ could be either moral uncertainty or costly monitoring. The presence of these ‘Epsilon States’ enable Islamic financial institutions with weak ethical commitments to create financial products where the deontological rules are followed, but their impact remains insignificant. Our universe features a harmonious match between laws and states: applying its laws to its states generates other states. This is a striking fact. Matters might have been otherwise. The universe might have been stillborn in a state unengaged by its laws. The problem of nomological harmony is that of explaining the noted striking fact. After introducing and developing this problem, we canvass candidate solutions and identify some of their virtues and vices. Studies have shown that a person can consciously believe that they value racial equality and desire not to perpetuate racial stigmas, but unwittingly exhibit racist attitudes and beliefs. In order to explain this discrepancy between conscious beliefs and behavior, scholars have turned their attention to unconscious racial prejudice. One approach that is gaining wide acceptance is the Implicit Bias Model, which appeals to distinct implicit and explicit cognitive processes, coupled with an account of the ways in which people unconsciously internalize (...) widespread stereotypes and stigmas. This article claims that although the Implicit Bias Model is in many respects useful, it leaves out a central aspect of unconscious racial prejudice: the underlying motivations and incentives for harboring racist attitudes and beliefs, which generate psychological resistances to knowing about or changing prejudices. A more complete account of unconscious racial prejudice can be developed by turning to theories of active ignorance, which contribute to what this article calls the Resistance Model. (shrink)

The documentary genre is one of the audiovisual mechanisms with the greatest media efficiency in the transmission of reality. However, depending on the nature of the story, the construction of the textual and audiovisual discourse is altered. In this article, we consider the following questions: Is the documentary a format that is faithful to reality? What modifications does the discourse undergo so that the story is enhanced? To go deeper into this aspect, we intend to analyse the different elements that (...) make up the documentary discourse in its transition from reality to fictionalised narrative. To this end, an inspection of the environmental dissemination documentary My Octopus Teacher (Netflix, 2020) will be carried out. An audiovisual proposal in which the coexistence between human and animal life turns environmental dissemination into a powerful instrument for transmitting scientific knowledge. (shrink)

Affective bonding to radical organizations is one of the most prominent features of a recruit’s personality. To better understand how affective bonding is established during the recruitment of youth for radicalization and how it is maintained afterward, it seems promising to adopt new insights and developments from the field of situated cognition and affectivity, particularly the concepts of Affective Scaffolding, Mind Invasion, and Self-Stimulatory Loops of Affectivity (SSLA). The three notions highlight both the intended structuring of the affective bonding by (...) the recruiting organizations and the immersive influence these settings have on the individuals. We will study the affective bonding between an individual and a radical group from two perspectives: first, from an organizational perspective, and second from a personal perspective. The first aims at understanding how extremist organizations “invade the mind” of young people, by providing carefully designed affective scaffolding: (a) during the recruitment process and (b) while being a full member of the organization. The second aims at identifying some of the affective loops which individuals who have joined the radical organization enter. (shrink)

Uno de los textos más conocidos de Bauman al respecto es Trabajo, consumismo y nuevos pobres; sin embargo, este es un tema que el sociólogo trata en otras obras. Aquí se pretende dar una visión en la que se tienen en cuenta la globalidad de sus escritos. Además, se dan unas claves que permiten comprender el enfoque que Bauman tiene del trabajo: se hace una (...) breve explicación de su perspectiva sociológica y de la importancia de la modernidad en su pensamiento. The author asks whether there was a “scientific ‘68”, and focuses on aspects of two specific methodological proposals defined in the 1940s and 50s by the terms “action research” and “mixing methods”, applied particularly to social sciences. In the first, the climate surrounding the events of 1968 contributed to heightening the participative element to be found –by definition– in “action research”; that is: the importance of making the research subjects themselves participants in the design, execution and application of the study (...) of which they are the focus. This approach captured the democratic and anti-authoritarian spirit at the heart of the proposal, which was part of the prevailing climate in those days. The repercussions of 1968 on “mixing methods” focused on studying what had actually occurred, especially between the youth and workers, and therefore, particularly from the point of view of sociology and social psychology, using a “mixed methods” approach. The author explores the proposal of Norman Denzin; but traces the recent origins of both “mixing methods” and “action research” back to the proposals of mainly Kurt Lewin and the Chicago School.
